Whenever I&rsquo;m working in <a href="http://www.denversrealestatenews.com/search-denvers-homes-for-sale-with-research-tools/" target='_blank'>Golden luxury homes</a> I&#8217;m always surprised to learn that a lot of Sellers don&#8217;t realize they can choose the title company that plays an integral role in managing the closing process and even performing the actual closing. Granted, most listing brokers have established relationships with title companies built after years of (hopefully) positive experiences and most listing brokers in Golden co luxury homes will strongly urge their clients to use whichever title company they are used to. However, in today&#8217;s crazy real estate market where every dollar of closing costs, every simple delay and every hiccup in the closing process can be the difference between closing the deal or losing the Buyer-it is more important than ever to choose a great title company.</p>
<p>Behind the scenes of a real estate transaction in <a href="http://colorado.blueroof.com/" target='_blank'>denver horse properties</a> a title company performs a bunch of functions and is relied upon by both agents (those representing Buyer and Seller or transaction agents) as well as Buyer and Seller to put together all of the responsibilities outlined in the  Purchase Contract including researching the various fees and much more.</p>
<p>Early in my career I learnedthe importance of a title company which would effectively facilitate the contract with proactive troubleshooting, consistent attention to detail and a high level of service.</p>
<p>Now running a team of brokers   working in Horse property I have the luxury of hand picking a title company from the plethora of options available. </p>
<p>Since every one of my contracts is managed as though it&#8217;s the most important transaction in the world &#8211; since it undoubtedly is for the people involved in it, I associate with the best of the best professionals to be sure every aspect of the transaction is handled at the highest level possible. So let me share with you the four key points to consider when choosing a title company that I use in Horse property:</p>
<p>Reputation and history- Certainly in this industry, history repeats itself. Lazy brokers  might make mistakes based on lack of knowledge while top performing brokers continue to be a resource for quicker&mdash;correct answers. In the same light title companies who drop the ball undoubtedly have a pattern of having dropped the ball in the past. Ask your friends and family, other real estate agents in your office and mortgage brokers for their good and bad testimonials. Since Title companies, at least in Horse property are similar to insurance agents in the sense that you are not actually buying the insurance from the title company the biggest consideration in reputation is their ability to consistently take your calls, return your calls and provide intelligent, accurate answers promptly. When a title rep. (sales rep.) takes you to lunch, ask what the bulk of their experience is; is it from new construction purchases, commercial transactions, land sales, refinances, for sale by owner or brokered resale.</p>

			<content:encoded><![CDATA[<p>Home ownership has its benefits &#8211; no monthly rent checks, the freedom to do with your home as you please (notwithstanding neighborhood covenants), the ability to recoup your purchase price, and knowing that every month you&#8217;re building financial equity in the home. </p>
<p>However despite all the positive aspects of owning your own home, it isn&#8217;t always easy. Home ownership comes with responsibilities, headaches and financial burdens that we&#8217;re not always ready to tackle.</p>
<p>In this article, we&#8217;ll cover 5 tips and questions that you can use to evaluate whether you&#8217;re ready for home ownership. </p>
<p>1. Are you ready to stay put?</p>
<p>Unless the housing market is booming, it doesn&#8217;t often make sense to buy a home that you&#8217;ll be living in for less than 3 or 4 years. Basically, buying and selling property comes with a lot of transaction costs, and if you&#8217;re in the house for less than 2 years, you&#8217;ll have to pay capital gains tax on any profit. </p>
<p>So when the plan isn&#8217;t to remain in the house for a long period of time, be ready to include the cost of the purchase and sale into your prospective budget &#8211; which typically includes thousands of dollars in residential and legal fees. </p>
<p>2. Sometimes it makes more sense to rent.</p>
<p>Depending on the housing market in your area, it could make more financial sense to rent an apartment or home for a few years. Calculate whether it costs more to rent or own in your area.</p>
<p>Typically, if your monthly rental payments are more than 35 percent less than the cost of ownership (including taxes, mortgage payments and any ownership fees), then it&#8217;s a good idea to continue renting for now. </p>
<p>3. Is your credit healthy?</p>
<p>Before buying a home, you may want to commit a year or two rebuilding a healthy credit score. Bad or poor credit could mean you&#8217;re either turned down for a home loan or you&#8217;ll be offered a prohibitively expensive <a href="http://www.home-mortgage-preparation.com/va-loan-rates.shtml" target='_blank'>interest rate</a> where you would end up paying tens of thousands of dollars more over the term of the <a href="http://www.home-mortgage-preparation.com/mortgage-how-much-can-i-borrow.shtml" target='_blank'>mortgage loan</a>. </p>
<p>Financially, it makes sense to wait a year or two while you build up your credit score. </p>
<p>4. Do you know what you can afford?</p>
<p>Do you understand the true cost of home ownership? Go beyond mortgage payments and be ready to evaluate all the true costs, including maintenance, upgrades and your own monthly personal expenses. Depending on the quality of the house structure, repairs alone could dry up your finances fairly quickly.</p>
<p>Typically, most prospective homeowners should budget for a house that costs about 2.5 times their gross annual salary (or less), while all monthly home payments shouldn&#8217;t exceed 30 percent of the gross income each month. </p>
<p>5. Can you raise a down payment?</p>
<p>Most <a href="http://www.home-mortgage-preparation.com/mortgage-broker-bond.shtml" target='_blank'>lenders</a> like to see at least a 20 percent down payment. If you&#8217;re unable to meet these terms, you may be able to get a piggyback loan or be required to take out what&#8217;s called PMI, or Private Mortgage Insurance, which is typically about .5 percent of your total mortgage amount. </p>
<p>This is insurance for the benefit of the lender in the event you default on your home mortgage loan.</p>
<p>Before you can truly be ready for home ownership, you should determine the answers to these questions. And in doing so, don&#8217;t make the mistake of being too quick to downplay the risks. </p>
<p>A mortgage is typically a 30-year commitment. Many who jump in prematurely wind up in a foreclosure situation or in bankruptcy.</p>

			<content:encoded><![CDATA[<p>So you&rsquo;ve found your dream holiday home, arranged your <a href="http://www.international-mortgages.co.uk/" target='_blank'>mortgage in Spain</a> and are now ready to complete the purchase</p>
<p>In Spain, the process of purchasing Spanish property is regulated, and the best thing that you can do to protect your interests is to employ an English-speaking solicitor or lawyer to assist you. You will want to make sure that the Spanish property you are purchasing is free of restrictive clauses and debts.</p>
<p> The best thing to do, when researching your purchase, is to hire a lawyer to check the background of any Spanish property you are considering. They will also be able to check the Nota Simple, verifying the property is registered. Your chosen solicitor should be able to check the registry of the property, which will show if the property is owned by the vendor, as well as any outstanding mortgages.</p>
<p>The legal process for purchasing property located in Spain falls under two types of transactions. The first legal document is the preliminary contract, known as Contrato privado de compraventa, and the second is the completion contract, known as Escritura de compraventa.</p>
<p>A preliminary individual sale bill should be signed after both sides agree to the cost. Before this Contrato privado de compraventa has been signed, however, the vendor needs to be able to provide proof that he or she owns the property, and that it is free of any charges. Debts are charged to the property themselves in Spain, and any outstanding <a href="http://www.thespanishmortgagelender.com/" target='_blank'>Spanish Mortgages</a>  amount would then be passed on to the purchaser. Nota Simple documents are designed to confirm whether or not a property contains any outstanding debts.</p>
<p>The preliminary sales contract will be drawn up to contain all of the necessary details including the date of completion, the purchase price and the description of the property. At this point you will also be more than likely required to pay a deposit of between 5 percent and 15 percent of the purchase price. A bonded client account is where the funds will be kept for you. You can sign the private preliminary sales contract and not put down a deposit but it is not advised.</p>
<p>The ultimate stage is the decond stage only as it will decide the future of the contract. It is also known as Escritura de compraventa stage. The purchaser will be required to pay the balance of the purchase price and all fees on the date of completion. Both the vendor and the buyer must sign the contract at the same time. This contract is equivalent to a deed on the purchased property. The purchaser will receive the public deed of conveyance, known in Spain as the escritura, in front of a Notary Public. A copy of this deed will also be passed to the tax office and to the property registry as well to make everything legal. In Spain, Notary Publics are public officials required to witness a deed of sale, but you should also make sure to have your own independent expert legal advice to make sure that your own interests are protected during this legal process. Remember too that as the buyer you will be responsible for paying the Notary Public&#8217;s charges along with the real estate sales taxes. </p>

<p> Enclosed are horror stories of Spanish properties and ways to avoid them.</p>
<p> A couple purchased a residence in a subdivision, but as the subdivision was completed, the developer filed for bankruptcy. To avoid losing their property to the bank, the couple was encouraged to complete the purchase. The deed was changed into their name but the outstanding mortgage was left payable to the bank rather than agreed or transferred to their name.</p>
<p> The bank issued a court order to possess the property and the couple could not get their mortgage, and ended up having to pay more than &euro; 50,000 to the bank over a period of two years to postpone legal action at 18% interest, and they still could not get the mortgage because of the lien on the property.</p>
<p> One woman bought a fully licensed property before a road was constructed on more than one third of her Rustica land, and she was only paid a small amount of compensation for her loss. The regional government has no obligation to communicate with the new owner after the purchase since the property was officially registered as land alone, as opposed to registering it as property containing a home.</p>
<p> One gentleman visited Spain at his own cost to look at a resale property that appeared to be an excellent value for the money. After spending time, effort and money for visit costs, reservation fees and lawyer fees he learned that he could not get the necessary mortgage loan because more than half of the property offered was not actually legally registered land and could not be used to obtain the mortgage. </p>
<p> One guy even put down a deposit on a property he was familiar in a village he liked. The first developer went into bankruptcy during the construction phase, but another developer took it over and then failed to complete it. The project does not meet the current five year build plan for the area and there is no full license and planning granted to the owner or the builder so the project is on permanent hold. </p>
